Data License Agreement
This Data License Agreement ("License") governs your access to and use of the Data. It is the license the checkout refers to when it states, "By downloading, you agree to the terms of your selected license tier." By purchasing a data license, downloading, or otherwise accessing the Data, you ("Licensee," "you") agree to this License. If you do not agree, do not purchase or download the Data.
This License is part of, and incorporates, our Terms of Service, Refund Policy, and Data Accuracy and Liability Disclaimer. The Data is provided "as is," may contain errors, and must not be relied on as a sole basis for decisions — read the Disclaimer before using it.
1. Definitions
- "Data" — the Daily AI Toll dataset made available for download (for example, as a CSV or JSON file), including all event records, excerpts, source references, causality labels, confidence scores, aggregate totals, and the selection, structure, coordination, and arrangement of that content.
- "Raw Data" — the Data, or any substantial part of it, in bulk, file, feed, or database form, whether or not reformatted (for example, the CSV/JSON file, or a copy of its records loaded into a spreadsheet or database).
- "Your Organization" — the single legal entity, or the individual, that purchased the license.
- "Internal Use" — use within Your Organization by employees and contractors acting for Your Organization, not for external distribution of the Raw Data.
2. Ownership
The Data is licensed, not sold. As between you and us, we (or our licensors) own all rights in the Data, including the selection, arrangement, structure, scoring, labeling, and presentation of the records, and all applicable copyright and database rights. You receive only the rights expressly granted below. All rights not expressly granted are reserved. Third-party sources, company names, and marks referenced in the Data belong to their respective owners; this License does not grant you any rights in them.
3. The two tiers
Your rights depend on the tier you purchased at checkout. The two tiers are distinct — read the one you bought.
Tier A — Journalist / Researcher (personal, non-commercial + cited editorial use)
3A.1 License grant. Subject to this License and to payment, we grant you a non-exclusive, non-transferable, non-sublicensable, worldwide license to:
- download and access the Data for your own use;
- use the Data internally for your personal research, analysis, and reporting; and
- make cited editorial use of the Data — that is, quote, cite, or reference specific facts, figures, or individual entries from the Data in journalism, academic work, or other editorial or research output (an article, paper, report, presentation, or post), with attribution as required in Section 5, provided that you do not thereby publish the Raw Data itself. 3A.2 What "cited editorial use" does and does not allow. You may state findings drawn from the Data and reproduce a limited number of individual data points needed to support your reporting or analysis. You may not publish, post, attach, or otherwise make available the Raw Data (or any substantial portion or bulk extract of it) as a downloadable file, feed, database, table dump, or dataset, even with attribution. The purpose of this tier is to let you report on and cite the Data, not to redistribute it. 3A.3 Non-commercial. This tier is for non-commercial use. Ordinary journalism and academic research — including work published by a news organization or institution, and work that happens to be behind a paywall or that you are paid a salary or fee to produce — is permitted editorial/research use. What is not permitted under this tier is using the Data as an input to a commercial product, service, or offering, or reselling access to it; those uses require the Commercial tier.
Tier B — Commercial (broader internal business use)
3B.1 License grant. Subject to this License and to payment, we grant Your Organization a non-exclusive, non-transferable, non-sublicensable, worldwide license to:
- download and access the Data;
- use the Data for Internal Use within Your Organization for any lawful business purpose — including internal analysis, research, benchmarking, modeling, reporting, and product or strategy development; and
- incorporate insights, findings, and derived results from the Data into your internal work product and into external deliverables (such as reports, analyses, presentations, or dashboards you provide to your own clients or audience), provided that any such external deliverable does not distribute the Raw Data itself and, where it references the Data as a source, includes the attribution described in Section 5. 3B.2 Derived results vs. Raw Data. You may externally share aggregated, transformed, or derived outputs (for example, charts, statistics, or conclusions you build from the Data) so long as a recipient cannot reconstruct or extract the Raw Data (or a substantial part of it) from what you share. You may not distribute the Raw Data itself, or any substantial portion or bulk extract, as a file, feed, table dump, database, or dataset. This tier broadens internal and derived use; it does not grant any right to redistribute or resell the dataset. 3B.3 Scope. This tier covers a single Your Organization. It does not cover affiliates, parents, or subsidiaries as separate licensees unless we agree in writing, and it does not permit offering the Data (or a data feed built from it) as a product to third parties.
4. Prohibited uses (all tiers)
Regardless of tier, you may not, and may not permit or enable anyone else to:
- resell, redistribute, publish, syndicate, or otherwise make available the Raw Data (or any substantial portion or bulk extract of it), whether for a fee or at no charge, and whether or not reformatted;
- sublicense the Data or purport to grant anyone else rights to it;
- offer the Data (or a feed, API, dataset, or database derived from it) as, or as part of, a product or service to third parties;
- use the Data to train, fine-tune, or build a competing dataset, database, or service that reproduces or substitutes for the Data or a substantial part of it;
- transfer, share, or assign your license or download/access credentials to any other person or organization;
- remove, obscure, or alter any attribution, source link, proprietary notice, confidence score, or causality label in a way that misrepresents the Data;
- present the Data, its confidence scores, or its causality labels as verified fact, certification, or an accusation of wrongdoing against any company or person, or in any false, misleading, or defamatory manner (see the Disclaimer);
- use the Data to make eligibility decisions about individuals (employment, credit, insurance, tenancy, or similar); or
- use the Data in violation of any applicable law or to infringe any third party's rights. You are solely responsible for how you use, characterize, and republish (as permitted) the Data, and for independently verifying any entry before relying on or repeating it.
5. Attribution
Tier A (Journalist / Researcher): attribution is required. Whenever you cite, quote, or reference the Data in any published or shared output, you must credit the source substantially as: "Source: Daily AI Toll (dailyaitoll.com)." For online use, the attribution should link to dailyaitoll.com where practical.
Tier B (Commercial): attribution is not required. You may credit the source as "Source: Daily AI Toll (dailyaitoll.com)" if you wish, but it is not a condition of this tier.
In all cases, attribution does not imply that Daily AI Toll endorses, reviewed, or is responsible for your use of the Data.
6. Term
This License begins when you complete your purchase and access the Data, and continues perpetually for the copy of the Data you purchased, unless terminated under Section 7. A one-time purchase licenses the Data as it exists at the time of purchase; it does not include any right to updates, future versions, ongoing feeds, or continued availability of downloads. Continued availability of any download or access link is not guaranteed.
7. Termination
This License terminates automatically, without notice, if you breach any of its terms — in particular the prohibited uses in Section 4. We may also suspend or revoke download/access links or terminate this License if we reasonably believe it is being misused.
Termination does not entitle you to any refund; all sales are final (see the Refund Policy). Sections 2, 4, 8, 9, and 10 survive termination.
8. No warranty; disclaimer incorporated
THE DATA IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, express or implied, including any warranty of accuracy, completeness, reliability, merchantability, fitness for a particular purpose, title, or non-infringement. The Data is compiled from third-party public sources and processed with automated (large language model) tools, may contain errors, and its confidence scores and causality labels are estimates and characterizations, not assertions of fact. You must independently verify the Data and must not rely on it as the sole basis for any decision. The Disclaimer is incorporated into this License in full.
9. Limitation of liability; indemnity
The limitation of liability and indemnification provisions of the Terms of Service (Sections 10 and 11) apply to this License in full and are incorporated by reference. Without limiting them, you are responsible for, and will indemnify us against claims arising from, your use, characterization, or permitted republication of the Data.
10. General
This License is governed by the laws of the State of Delaware, United States, consistent with the Terms of Service. If any provision is unenforceable, the rest remains in effect. You may not assign this License; we may assign it in connection with a transfer of the project. This License, with the documents it incorporates, is the entire agreement about your use of the Data. In the event of a conflict between this License and the summary in the Terms of Service, this License controls as to the Data.
